China warns US against putting bilateral trade ties in jeopardy

China’s Ministry of Commerce urged the United States to “pause on the brink of a precipice” and make prudent decisions so as not to put bilateral trade relations in jeopardy.

Calling the recent US restrictive measures on China “a very bad precedent”,an MOC spokesperson said it went against “the interests of China, the United States and the world at large”.

China will not sit idly watching its legitimate rights and interests being damaged under any circumstance, the spokesperson said.

Despite strong warnings from business groups and trade experts the U.S.President Donald Trump on March 22 signed a memorandum that could impose tariffs on up to USD 60 billion of imports from China and restrictions on Chinese investment in the United States.

China will properly handle the United States’ request for consultations regarding the protection of intellectual property rights in accordance with the World Trade Organization’s dispute settlement procedures, the Ministry of Commerce said in a statement.

Tech giants Tencent Holdings Ltd. and Alibaba Group Holding Ltd. were the most active Chinese companies in terms of over-seas investment last year, according to a survey jointly released by the Hurun Report and Shanghai-based merger and acquisition advisory firm DealGlobe.

The spokesperson also reiterated China’s stance of not wanting or fearing trade wars.

“We have confidence and capability in dealing with any challenges,” he added.

China will properly handle IP rights protection

The memorandum is based on the so-called Section 301 investigation into alleged Chinese intellectual property and technology transfer practices, launched by the Trump administration in August 2017.

China has already received a request for consultation from the US, an official from the ministry’s Department of Treaty and Law said.

The ministry’s comments came after the Office of the US Trade Representative submitted a consultation request to China under the WTO’s dispute settlement mechanism, alleging that the Chinese government’s measures “did not comply with the relevant agreement regarding the conditions for technology licensing”.

The ministry said the Chinese government has always attached great importance to the protection of intellectual property rights and has taken many effective steps to protect the legitimate rights and interests of both domestic and foreign businesses.

Tencent and Alibaba made seven overseas investments in 2017, according to the 2018 China Enterprise Cross-border M&A Special Report. The transaction volume of Tencent’s seven investments reached RMB 38 billion (USD 6 billion), with the largest used to acquire a minority stake in India’s biggest e-commerce firm Flipkart.

“We firmly oppose it. It is a typical unilateral and protectionist practice.” The spokesperson said.

“The achievements have been obvious to all.China has always respected the WTO rules and maintained the multilateral trading system,” the statement said.

Rupert Hoogewerf, founder and chief researcher at the Hurun Report, said Tencent and Alibaba’s ambitious outbound investment reflected the entire process of learning, replicating, growth and innovation of Chinese privately-owned enterprises.

The transaction volume of Alibaba’s overseas investments last year totaled RMB 23 billion. The largest was the RMB 7.2 billion investment in the Indonesian e-commerce platform PT Tokopedia, according to the report.

Of the top 100 overseas M&As by transaction value made by Chinese companies last year, 25 were in the TMT industry, nearly twice the number in 2016. However, out of the total last year, the TMT industry accounted for 83, second to the manufacturing industry which accounted for 114.

In general, Chinese companies’ overseas investment activity cooled in 2017 with a total of 400 overseas M&As last year, down 1.7% from 2016. Among these investments,312 disclosed their transaction volume, which has declined 28 percent year-on-year to RMB 960 billion.
